AI Act Risk Categories

The EU AI Act classifies AI systems into four risk categories, each with different regulatory requirements.

Unacceptable Risk

AI systems that pose clear threats to safety, livelihoods, or rights. Prohibited.

Examples:

  • Social scoring
  • Real-time biometric surveillance
  • Manipulative AI

High Risk

AI systems in critical areas requiring conformity assessment and registration.

Examples:

  • Critical infrastructure
  • Employment decisions
  • Education
  • Law enforcement

Limited Risk

AI systems with transparency obligations.

Examples:

  • Chatbots
  • Emotion recognition
  • Deep fakes

Minimal Risk

AI systems with no specific obligations under the AI Act.

Examples:

  • Spam filters
  • Video games
  • Inventory management

Risk Management System

Establish and maintain a risk management system throughout the AI lifecycle.

Technical Documentation

Prepare comprehensive technical documentation demonstrating compliance with requirements.

Data Governance

Implement data governance practices for training, validation, and testing datasets.

Human Oversight

Design systems to enable effective human oversight and intervention capabilities.

Penalties for Non-Compliance

Prohibited AI practicesUp to €35 million or 7% of global turnover
High-risk AI system violationsUp to €35 million or 7% of global turnover
Other AI Act violationsUp to €15 million or 3% of global turnover
Providing false information to authoritiesUp to €7.5 million or 1% of global turnover

Penalties are calculated based on the higher of the fixed amount or percentage of global annual turnover. Infringements may also result in temporary or permanent bans on AI systems in the EU market.

Implementation Timeline

August 2024

AI Act entered into force (20 days after publication in Official Journal)

February 2025

Prohibited AI practices ban takes effect (6 months after entry into force)

August 2025

GPAI model rules and governance structure apply (12 months)

August 2026

Full requirements for high-risk AI systems in Annex III take effect (24 months)

August 2027

Full compliance required for all AI systems including Annex I high-risk systems (36 months)
