These General Terms and Conditions apply to all services provided by Kisum GmbH (hereinafter 'Provider') to its customers. By using our services, you agree to these terms. These terms apply to both consumers and business customers.

Kisum GmbH provides AI-powered compliance assessment tools for EU regulations including the AI Act, Cyber Resilience Act, and NIS-2 Directive. Our services include automated questionnaires, compliance analysis, and report generation. Our assessments provide guidance but do not constitute legal advice.

Current prices are displayed on our website. All prices are in Euros and include statutory VAT where applicable. Payment is due at the time of purchase and is processed securely through Stripe. We do not store complete credit card information on our servers.

Our compliance assessments provide preliminary guidance and do not constitute legal advice. Kisum GmbH is not liable for business decisions made based on our reports. Our liability is limited to the amount paid for the respective service. This limitation does not apply to damages caused by intent or gross negligence.

In accordance with EU Directive 2011/83/EU and German Civil Code (BGB) § 312g: For Digital Services: The right of withdrawal expires when the performance of the service has begun with the consumer's prior express consent and acknowledgment that the right of withdrawal is lost. For Assessment Services: By initiating a paid assessment and confirming your purchase, you expressly consent to immediate service commencement and acknowledge that your right of withdrawal expires upon report generation. Account Cancellation: You may cancel your account at any time. Access to previously purchased reports remains available for 12 months after cancellation.

These terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction for all disputes is Munich, Germany, unless mandatory consumer protection laws dictate otherwise.

Our compliance assessment services are provided as digital services with instant delivery. Upon purchase, you receive immediate access to: • AI-powered compliance analysis • Detailed assessment reports • PDF document generation As these are digital services that begin immediately upon purchase with your express consent, the statutory right of withdrawal does not apply once the service delivery has begun.

Our services utilize artificial intelligence (Anthropic Claude API) for compliance analysis. While we strive for accuracy: • AI-generated content is for informational purposes only • Results do not constitute legal, tax, or professional advice • Users should verify critical information with qualified professionals • AI capabilities and limitations are continuously evolving Kisum GmbH does not guarantee the completeness or accuracy of AI-generated assessments.

Due to the nature of digital services with instant delivery: • Unpurchased Reports: Free assessments can be deleted at any time • Purchased Reports: No refunds are available once a paid report has been generated, as the digital service has been fully rendered • Technical Failures: In cases of technical failure preventing report generation, we will either provide the service or issue a full refund • Duplicate Purchases: Contact support within 48 hours for resolution This policy complies with EU consumer protection directives for digital content (Directive 2011/83/EU).

All content, reports, and materials provided through our services remain the intellectual property of Kisum GmbH. You receive a non-exclusive, non-transferable right to use purchased reports for your internal business purposes.

We process personal data in accordance with our Privacy Policy and GDPR requirements. Assessment data is stored securely and used only for providing our services. For details, please refer to our Privacy Policy (Datenschutzerklärung).

We reserve the right to modify these terms. Changes will be communicated via email or website notification at least 14 days before taking effect. Continued use of our services after changes take effect constitutes acceptance of the modified terms.
